{"id":11734,"date":"2016-01-19T00:00:00","date_gmt":"2016-01-19T00:00:00","guid":{"rendered":"http:\/\/statescoop.scpnewsgrp.com\/illinois-weighs-bill-to-speed-access-to-police-video-footage-in-wake-of-laquan-mcdonald-case\/"},"modified":"2021-09-03T14:18:11","modified_gmt":"2021-09-03T18:18:11","slug":"illinois-weighs-bill-to-speed-access-to-police-video-footage-in-wake-of-laquan-mcdonald-case","status":"publish","type":"post","link":"https:\/\/statescoop.com\/illinois-weighs-bill-to-speed-access-to-police-video-footage-in-wake-of-laquan-mcdonald-case\/","title":{"rendered":"Illinois weighs bill to speed access to police video footage in wake of Laquan McDonald case"},"content":{"rendered":"<p>With the investigation into the police shooting of Laquan McDonald continuing to stir up controversy in Chicago, Illinois lawmakers are pushing to drastically\u00a0increase\u00a0public access to video footage of officer-involved shootings and deaths statewide.<\/p>\n<p>Last week, the Legislature took up\u00a0<a href=\"http:\/\/ilga.gov\/legislation\/fulltext.asp?DocName=09900HB4355&amp;GA=99&amp;SessionId=88&amp;DocTypeId=HB&amp;LegID=93026&amp;DocNum=4355&amp;GAID=13&amp;Session=&amp;print=true\">a bill introduced by Rep. Arthur Turner<\/a>\u00a0that would amend the\u00a0state\u2019s Freedom of Information Act to ensure that\u00a0footage of the deadly incidents collected by law enforcement body cameras and dashboard cameras would be open by default.<\/p>\n<p>Currently, local and state police, as well as sheriff&#8217;s offices,\u00a0have five days to decide whether to approve public records requests for the videos. Turner\u2019s bill would leave it up to a judge instead, requiring the agency to prove in an \u201cexpedited hearing\u201d that those exemptions apply and the video should be kept confidential.<\/p>\n<p>Turner told StateScoop that he intended the bill as a direct response to the McDonald case, where only a journalist\u2019s lawsuit prompted the release of video of the incident, a full 13 months after the shooting took place.<\/p>\n<p>\u201cIt\u2019s about transparency and restoring public trust in our judicial system and in the police,\u201d Turner said. \u201cIt\u2019s just injecting a judge into the process, and I believe that will make community members more comfortable, it makes prosecutors and lawyers in the case more comfortable.\u201d<\/p>\n<p>To hammer out the details of the bill, Turner said he worked with Attorney General Lisa Madigan\u2019s office before he pre-filed it last month. Since then, he noted that it\u2019s attracted bipartisan support in the Legislature, and earned high marks from a variety of state\u2019s attorneys he\u2019s spoken with about the measure.<\/p>\n<p>\u201cFor them, it\u2019s all about making sure that, if there\u2019s an ongoing investigation happening, that we\u2019re not doing anything to the detriment of whoever\u2019s involved in the case or the case itself,\u201d Turner said.<\/p>\n<p>After the extreme measures required for the release of the McDonald video, open government advocates believe the bill is a crucial step for the state.<\/p>\n<p>\u201cThe bill would do away with a ton of the stalling and delay tactics that public bodies oftentimes use to avoid releasing information in a timely manner,\u201d said Josh Sharp, director of government relations for the Illinois Press Association.<\/p>\n<p>But Dominic D\u2019Ambrosio \u2014 deputy chief of operations for the Oak Forest, Illinois, police department \u2014 sees some problems\u00a0with the bill. As a law enforcement leader in a Chicago suburb, he said he appreciates the need for anything that generates \u201cdeeper trust from the citizenry,\u201d but worries that the law lacks specificity.<\/p>\n<p>\u201cHow do we exactly logistically manage this type of law?\u201d D\u2019Ambrosio said. \u201cSo often, we just see lawmakers having the right intent in putting the right concept into place, but there\u2019s so many variables.\u201d<\/p>\n<p>Specifically, he wonders how quickly law enforcement agencies will have to make these videos available if they aren\u2019t exempt from disclosure, and what kind of costs will be associated with the process. If an agency does want a hearing, D\u2019Ambrosio warned that the process may put even more strain on the state\u2019s swamped court systems.<\/p>\n<p>Patrick Cotter, a former federal prosecutor currently working as a defense attorney at the Chicago firm\u00a0Greensfelder, Hemker &amp; Gale, P.C., worries less about the bill\u2019s logistical challenges and more about its legal implications.<\/p>\n<p>\u201cFor a couple hundred years we\u2019ve been trying to make trials fairer and cases fairer, and one of the ways we do that is not by throwing evidence out there willy-nilly,\u201d Cotter said.<\/p>\n<p>Cotter said he thinks that\u00a0speeding the release of the footage could prejudice the public against either the police officer involved in the incident or the victim ahead of any trial, and cautioned that video evidence isn\u2019t as definitive as it may appear.<\/p>\n<p>\u201cVideo is a tool,\u201d Cotter said. \u201cIt is one type of evidence, it\u2019s not the only piece of evidence, it\u2019s not even always the best piece of evidence.\u201d<\/p>\n<p>Additionally, Cotter worries judges may be forced to make decisions on the videos based simply on \u201cundeveloped information\u201d about the case. By contrast, Mark McBride, a veteran criminal defense attorney, is concerned that judges might be overly inclined to rule in favor of shielding the footage.<\/p>\n<p>\u201cThe moral arc of judging favors the state,\u201d McBride said.<\/p>\n<p>Should the bill become law, D\u2019Ambrosio also wonders if the public could accept a court\u2019s ruling to keep the footage confidential.<\/p>\n<p>\u201cMaybe there\u2019s a reason why it was denied in court,\u201d D\u2019Ambrosio said. \u201cFrom the media side, would that be an acceptable response?\u201d<\/p>\n<p>However, the bill has plenty of hurdles to clear before those questions come to the fore. The legislative analytics company FiscalNote estimates that the bill has an 81 percent chance of passing if it comes to a vote, but because the bill\u2019s sponsors lack committee influence, it has just a 5.9 percent chance of ever making to the floor.<\/p>\n<p>Nevertheless, Turner feels a \u201csense of urgency\u201d around the issue will help the bill\u2019s chances.<\/p>\n<p>\u201cWe want to
